CHERRY HILL, NJ (November 4, 2019) – Soliman & Associates, PC is pleased to announce that Attorney Ahmed Soliman has received a Trial Judgment in the District of New Jersey, Camden Vicinage, in which he defended a trademark infringement case under the Lanham Act against Il Portico, a famous high-end restaurant in the Philadelphia Market. The case, Fife & Drum v. Il Portico, case number 1:17-cv-03676-NLH-JS, sought enforcement of a trademark by Plaintiff Fife & Drum, Inc. against the owner of the legendary Philadelphia area restaurants Il Portico and Tiramisu.
Albert DelBello, the renowned Italian Chef, first opened the five-star Il Portico restaurant in Philadelphia in 1995, and later opened the equally well-known restaurant Tiramisu. For 17 years thereafter, both Chef Delbello and Il Portico received acclaim on television and in the Philadelphia area publications for the quality food found at his Italian restaurants.
In 2016 Chef Delbello relocated his Il Portico restaurant from Center City Philadelphia to Burlington, NJ. Plaintiff Fife & Drum filed suit in 2017 for infringement of its trademark for a restaurant of the same name in Tappan, NY, which was registered in 1990.
“Justice was served… You don’t sit by for this long and allow the name to flourish for so many years and then try to force someone to change their name,” said Chef Albert DelBello. “When it comes to hospitality for fine Italian dining, there has never been a restaurant like Il Portico in Philadelphia and I’m glad that our customers will still be able to visit it in Burlington. I’m still here cooking for them.”
“I’m pleased with the decision of the Court,” added Attorney Ahmed Soliman, who defended the case and served as the trial attorney for Il Portico as well. “The Court correctly reasoned that Il Portico is entitled to protections under federal law in situations like this where there is no likelihood of confusion between a restaurant in New York and thaT of my client nearly 100 miles away, and where the trademark was never enforced by Plaintiff for several years.”
